PLANNING COMMISSION Meeting
Meeting Continuation (From 7/11/17)
July 18, 2017

Chairman Dan Rosales is on vacation, so Vice Chair Ron Turner convened the Planning Commission continuation meeting. Seven PC members present.

Pending motion from July 11 made by Dan Michalak withdrawn (motion to approve Independence Water & Sanitation District).

Staff report:

Motion to approve (with conditions & findings) Independence subdivision preliminary plat by Justin Klassen; seconded by Dan Michalak.

Preliminary plat discussion - set to go before BOCC September 5 (continuation to be requested on August 9); will be an evening meeting 9/5 @6PM at fairgrounds; will continue on 9/6 @6PM if necessary. Continued on September 7 @10AM if needed, in BOCC room.

Subdivision Improvement Agreement (SIA) has to be approved by county before BOCC meeting. Passed 7-0.

Motion to approve (with conditions & findings) Independence subdivision final plat by Dan Michalak; seconded by Jim Keen.

Final plat discussion - repetitive conditions from preliminary plat? - staff stated that it’s a separate application, so conditions need to stay in final plat; amendment to motion for additional condition proposed: Delbert Rd completed from Singing Hills to Rd 158, and Hancock Way completed from Rd 158 to Delbert Rd (after completion of first 328 units) - staff stated that the SIA controls this (SIA not presented to PC yet; Kyle Fenner claims an SIA is not part of zoning regs) ; (Robert’s Rules of Order got lost again…..PC tried to have discussion without a second to additional condition); amended motion made to include additional condition of road completions; Tim Craft claims that this is an “arbitrary requirement” of applicant; amended motion withdrawn. Passed 7-0

Motion to approve (with conditions & findings) Independence Water & Sanitation District by Bob Lewis.

Water & Sanitation District discussion-amended to state that the “District shall not export water outside of Elbert County, with the exception for provisions of any emergency services.” Definition of emergency services? Perhaps a fire across the street? District can move water within Elbert County - can sell to other communities and expand boundaries of their district; so Independence could service other developments in EC if they amend their service plan. Motion passed.

Motion to approve (with conditions & findings) Independence Overlay Metropolitan District by Bob Lewis; seconded by Justin Klassen.

Overlay discussion - included same wording as W&S District concerning water leaving the county, in addition to other conditions. Motion passed.

Motion to approve (with conditions & findings) Independence Metropolitan District #1 by Justin Klassen. Seconded by Jim Keen.

Metro District #1 discussion - same wording regarding water leaving the county, in addition to other conditions. Motion passed.

Motion to approve (with conditions & findings) Independence Metropolitan District #2 by Jim Keen. Seconded by Brian Harris.

Metro District #2 discussion - same wording regarding water leaving the county, in addition to other conditions. Motion passed.

Motion to approve (with conditions & findings) Independence Metropolitan District #3 by Paula Wilderman. Seconded by Justin Klassen.

Metro District #3 discussion - same wording regarding water leaving the county, in addition to other conditions. Motion passed.

Motion to approve (with conditions & findings) Independence Metropolitan District #4 by Paula Wilderman. Seconded by Dan Michalak.

Metro District #4 discussion - same wording regarding water leaving the county, in addition to other conditions. Motion passed.

No further comments by Planning Commission members.

(Editorial comment: have any of these planning commissioners heard of the United Water and Sanitation District, located in Elbert County, with the authority to distribute water statewide? Can they connect the dots?)

Kyle Fenner reiterated BOCC dates moving forward. She stated that PC members can discuss Independence with public, but BOCC cannot engage in discussion with public about this development.

Summary: all 6 special districts and the preliminary and final plats were recommended for approval to the BOCC for a final vote. All motions passed unanimously to approve the Independence development.
